What Happens After Your Second No-Insurance Conviction

You were pulled over without insurance in Georgia, and this is your second offense. The Georgia Department of Driver Services suspends your license for 60 days, effective immediately from the conviction date. You cannot drive legally during this period, and the suspension does not lift automatically when the 60 days end.

After the suspension period, you face a $200 reinstatement fee and a mandatory three-year proof-of-insurance filing requirement. Georgia uses Form SR-22A for second and subsequent no-insurance convictions, not the standard SR-22 form that applies to DUI and other high-risk violations. Confusing the two forms delays reinstatement and extends the time you cannot drive.

The SR-22A filing period starts when DDS receives the certificate, not when you buy the policy.

License Suspension Period

60 days

Georgia suspends your license for 60 days after a second no-insurance conviction, measured from the conviction date. The suspension does not lift automatically — you must complete reinstatement steps and pay the fee before driving legally again.

SR-22A Filing Requirement for Second Offenses

Georgia requires Form SR-22A (Georgia Safety Responsibility Insurance Certificate) for second or subsequent no-insurance convictions. This is a different form than the SR-22 used for DUI and other violations. The SR-22A proves you carry at least the state's minimum liability coverage: $25,000 bodily injury per person, $50,000 bodily injury per accident, and $25,000 property damage.

Your insurance carrier files the SR-22A electronically with the Georgia Department of Driver Services. The filing period lasts three years from the date DDS receives the certificate. If your policy lapses or cancels during those three years, the carrier notifies DDS immediately, and your license suspends again until you file a new SR-22A and pay another reinstatement fee.

Not every carrier writes SR-22A policies. Georgia's carrier roster includes specialists like Acceptance Insurance, Bristol West, Dairyland, Direct Auto, GAINSCO, The General, and Infinity that write coverage for drivers with no-insurance convictions. Standard carriers like State Farm and Allstate write SR-22A for existing customers but may decline new applications after a second offense.

The SR-22A filing period starts when DDS receives the certificate, not when you buy the policy. Any gap between conviction and filing extends the time before you can reinstate.

Reinstatement Process After Suspension Ends

The 60-day suspension does not lift automatically. You must complete three steps in order before DDS reinstates your license.

First, obtain an SR-22A policy from a carrier licensed in Georgia. The carrier files the certificate electronically with DDS. You receive a copy for your records, but DDS processes the filing directly from the carrier. The filing confirms you carry at least Georgia's minimum liability limits and commits the carrier to notify DDS if the policy cancels.

Second, pay the $200 reinstatement fee to the Georgia Department of Driver Services. You can pay online, by mail, or at a DDS Customer Service Center. The fee is non-refundable and does not reduce if you complete reinstatement early. Third, visit a DDS Customer Service Center to surrender your suspended license or execute a lost-license affidavit (Form DS-250A) if you no longer have the physical card. DDS issues your reinstated license once all three steps are verified.

What Triggers the Three-Year Filing Clock

The three-year SR-22A filing period begins the day DDS receives the electronic certificate from your carrier, not the day you purchase the policy. If you wait two weeks after your conviction to buy coverage, those two weeks do not count toward the three years. The clock starts only when the carrier transmits the filing.

Any lapse during the three years resets the process. If your policy cancels in year two because you missed a payment, DDS suspends your license again immediately. You must file a new SR-22A, pay another $200 reinstatement fee, and restart the three-year period from the new filing date. Carriers report lapses to DDS within one business day, so there is no grace period to reinstate a canceled policy before suspension takes effect.

Switching carriers during the three-year period is allowed, but the new carrier must file an SR-22A before you cancel the old policy. A gap of even one day between policies triggers a suspension. Coordinate the overlap with both carriers to ensure continuous coverage and uninterrupted filing.

Georgia Reinstatement Fee

$200

Georgia charges a $200 reinstatement fee after a second no-insurance suspension. The fee is paid to the Department of Driver Services and is required before your license is reinstated, even after the 60-day suspension period ends.

Driving During Suspension and Additional Penalties

Driving on a suspended license in Georgia is a misdemeanor. If you are caught driving during the 60-day suspension or before completing reinstatement, you face additional fines, possible jail time, and an extended suspension period. The court may add up to 12 months to your suspension, and a third no-insurance conviction escalates penalties further, including potential vehicle impoundment.

Georgia law does not offer a limited driving permit or hardship license for no-insurance suspensions. The Limited Driving Permit available for DUI offenses does not apply here. You cannot drive for work, medical appointments, or any other reason during the suspension period unless you complete early reinstatement by filing the SR-22A and paying the fee before the 60 days end.

Compare Carriers That Write SR-22A Policies

Not every carrier in Georgia writes SR-22A policies for drivers with two no-insurance convictions. Carriers that specialize in high-risk coverage — Acceptance Insurance, Bristol West, Dairyland, Direct Auto, GAINSCO, The General, and Infinity — write SR-22A policies and file electronically with DDS. Standard carriers like Geico, Progressive, and State Farm write SR-22A for existing customers but may decline new applications after a second offense.

Compare quotes from at least three carriers that confirm they write SR-22A in Georgia. Verify the carrier files electronically with DDS and ask how quickly the filing transmits after you bind the policy. Some carriers file within hours; others take up to three business days. The faster the filing reaches DDS, the sooner your three-year clock starts and the sooner you can reinstate your license.
